Apple's terms

Your use of the app is also subject to Apple's Standard Licensed Application End User License Agreement (the “Apple EULA”). These terms supplement the Apple EULA. If they conflict on a point, the Apple EULA controls.

License to use the app

David Casteel Pictures grants you a personal, non-exclusive, non-transferable license to use ARTEFEKT on Apple devices you own or control, subject to these terms and the Apple EULA.

Free trial, subscription, and purchase

• Free trial: new users may get a 7-day trial with full access to the app.
• After the trial, continued use requires either a monthly subscription or a one-time purchase. Prices are shown in the App Store and in the app before you confirm, and may vary by region or change over time.
• Monthly subscription: payment is charged to your Apple ID when you confirm the purchase, or when the trial ends. The subscription renews automatically each month unless you cancel at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the period ends. You can manage or cancel a subscription in iOS Settings under your name, then Subscriptions. Deleting the app does not cancel a subscription.
• One-time purchase: a single payment. It does not renew.
• Refunds are handled by Apple under its policies. Request one through Apple.
• Your photos and videos stay yours, and stay in your Photos library, whether or not you subscribe.

Your content

Photos and videos you capture, import, or edit with ARTEFEKT belong entirely to you. We claim no ownership of, and no license to, anything you create with the app. It is processed on your device and never sent to us. You may use what you create for any purpose, including commercial work. You are responsible for having the right to use anything you import.

Styles

A style is a combination of effect and enhance settings. A style you create and save is yours. ARTEFEKT's effects, their names, and the software that produces them remain ours.

Keep your own backups

ARTEFEKT may contain bugs, and your device may run short of memory during heavy use. Keep copies of work that matters. Photos and videos saved to your Photos library are managed by iOS and can be backed up with iCloud or your preferred method. Deleting an item from the ARTEFEKT gallery also deletes it from your Photos library.

Acceptable use

You agree not to:

• Use the app for any unlawful purpose
• Copy, resell, or redistribute the app
• Reverse-engineer, decompile, or extract the app's source code beyond what applicable law permits
• Interfere with or disrupt the app's normal operation

Intellectual property

The ARTEFEKT app, including its design, branding, image-processing effects, and underlying software, is the property of David Casteel Pictures and is protected by applicable intellectual property laws. These terms give you no rights to that property beyond the license above.

No warranty

ARTEFEKT is provided “as is” and “as available,” without warranties of any kind, express or implied, including fitness for a particular purpose. We do not guarantee that the app will be error-free or uninterrupted.

Limitation of liability

To the maximum extent permitted by law, David Casteel Pictures is not liable for any indirect, incidental, or consequential damages arising from your use of the app, including lost or corrupted photos or videos. Our total liability for any claim is limited to the amount you paid for the app in the 12 months before the claim. Some places do not allow these limits, so they may not apply to you in full.

Termination

We may suspend or end your access to the app if you violate these terms. You may stop using the app at any time.

Changes to these terms

We may update these terms from time to time. Continued use of the app after a change means you accept the updated terms.

Governing law

These terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles.
